These Terms of Service (“Terms”) govern your use of felicimart.shop and any purchase from Felicimart. The store is operated by Simec Steel, Inc. Throughout these Terms, “Felicimart,” “we,” “us,” and “our” refer to Simec Steel, Inc.

By visiting the Site or purchasing from us, you agree to these Terms and to the policies incorporated by reference, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the Site. Nothing in these Terms limits rights that cannot lawfully be waived.

1. Eligibility and Accounts

You must be at least the age of majority where you live, or use the Site with the permission and supervision of a parent or legal guardian. You are responsible for providing accurate information, protecting your account credentials, and notifying us of suspected unauthorized use.

2. Store Use

You may use the Site only for lawful personal or commercial shopping purposes. You may not interfere with the Site, introduce malicious code, scrape or harvest data without authorization, circumvent security controls, impersonate another person, infringe intellectual-property rights, or use the services for unlawful, fraudulent, or abusive activity.

3. Product Information

We make reasonable efforts to display product descriptions, colors, images, availability, and specifications accurately. Screen settings and manufacturing variations may affect appearance. We may correct errors, update information, or discontinue a product at any time. Such changes do not affect an order already accepted except where correction is legally permitted and communicated to you.

4. Prices, Billing, Taxes, and Shipping Charges

Prices are shown in the currency displayed at checkout and may change before an order is submitted. Any applicable charge will be shown before you confirm payment. Orders with a merchandise subtotal greater than US$30 after discounts receive free standard shipping. Shipping charges for lower-value orders are displayed at checkout.

Felicimart covers applicable import duties, customs charges, and import taxes connected with delivery, so customers are not required to pay them separately. Contact us before paying any unexpected import charge requested by a carrier.

You agree to provide current and complete billing, payment, and contact information. By submitting payment details, you represent that you are authorized to use the selected payment method.

5. Orders

An order confirmation acknowledges that we received your order; it does not necessarily mean that we accepted it. We may refuse or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or listing errors, legal restrictions, or inability to verify payment or delivery information. If we cancel after payment, we will refund the canceled amount to the original payment method.

We may reasonably limit quantities per customer, household, account, payment method, or address to prevent resale abuse or fraud.

6. Shipping, Delivery, Returns, and Refunds

Orders generally require 2–3 business days for processing, followed by an estimated delivery period of 20–45 calendar days. Estimates are not guarantees and may be affected by carrier or customs delays. Shipping, tracking, missing-package procedures, and delivery details are governed by our Shipping Policy.

Eligible items may be returned free of charge within 30 days after receipt. Refunds and exclusions are governed by our Return and Refund Policy. Approved refunds normally appear in the original payment account within 3–7 business days after issuance, although financial institutions may take longer.

7. Intellectual Property

The Site and its content, including text, graphics, logos, photographs, product presentation, and software, are owned by or licensed to Felicimart and are protected by applicable intellectual-property laws. You may use the Site for personal, non-commercial shopping purposes. No content may be copied, modified, distributed, sold, or exploited without prior written permission, except as allowed by law.

8. Reviews and Other Submissions

If you submit a review, suggestion, photograph, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating, improving, and promoting the store, subject to applicable privacy law. We may remove content that violates these Terms.

The Site may use or link to services operated by third parties. We do not control and are not responsible for third-party content, terms, products, or privacy practices. Your use of a third-party service may be subject to separate terms.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Site and services are provided on an “as is” and “as available” basis. We do not promise uninterrupted or error-free access. Products remain subject to any express product warranty provided at purchase and to all mandatory consumer guarantees. Some jurisdictions do not allow certain warranty exclusions, so those exclusions may not apply to you.

11. Limitation of Liability

To the maximum extent permitted by law, Felicimart, Simec Steel, Inc., and their directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, punitive, or consequential loss arising from use of the Site or products. Where liability cannot be excluded, it will be limited only to the extent allowed by law. This section does not exclude liability for fraud, willful misconduct, personal injury caused by negligence, or any liability that cannot legally be limited.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Felicimart and Simec Steel, Inc. from third-party claims arising from your unlawful misuse of the Site, your breach of these Terms, or your violation of another person’s rights.

13. Termination

We may suspend or terminate access when reasonably necessary to protect the Site, our customers, or our legal rights, including for fraud, abuse, or a material breach of these Terms. Provisions that by their nature should survive termination will remain effective.

14. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules. Courts with jurisdiction in San Diego County, California may hear disputes, except where mandatory consumer law gives you the right to bring a claim elsewhere.

15. General Terms

If any provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms and the incorporated policies constitute the agreement between you and us concerning the Site and supersede earlier communications on the same subject.

16. Changes to These Terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively from the date posted unless applicable law requires otherwise. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.
